TERMS OF SERVICE
LAST UPDATE:8/17/26This contract applies to the artist (me) and person or institution further called Client purchasing from me, a work of art further called Product. By ordering Product from me the Client agrees to the following terms and conditions:PAYMENTS
1. Client agrees to pay the due amount upfront for any orders of value lower or equal to 150.
2. On orders above 200 Client agrees to pay half the total upfront. The other half has to be paid on agreed payment plan date.
3. Any other payment schedule has to be mutually agreed before work on the Product commences.
4. Client accepts that work on the Product will not commence until payment has been received by me according to the above schedule.PRODUCT DELIVERY
6. Client agrees that Product will be delivered digitally to email address provided by Client, after the final payment has been received by me.
7. Any other method of delivery, either digital or physical, has to be mutually agreed before the work commences. Client is obliged to bear any costs incurred by alternative delivery method, such as postal costs, material costs, digital service subscription fees etc.
8. It is sole responsibility of Client to propose delivery method which works for both parties. I cannot be held accountable for the Client's loss of access to the delivery method, loss of delivered files, impediments such as spam filters or any other technical obstacles outside responsibility of me.
8b. Upon delivery of the product, it is the Client's responsibility to store it properly. Loss of product due to negligence will not be reimbursed by me. I can not guarantee that the original copy of the product will be available in the case that the Client lost their files.REVISIONS
9. Client has the right to 3 complete revisions in the sketching/line art phase.
10. Client has right to a reasonable amount of minor edits after completion, such as changing an eyecolor or fixing a small detail, up to an additional 10% of the total time spent on creating the originally delivered Product. Any requests above that, not minor, will require a prior mutual agreement and will result in a proportional increase of order value. Any such increase will be paid separately. Work on any such excessive requests will not commence until the payment for the additional changes have been received.CURRENCY CONVERSIONS
11. Client agrees to pay the total amount specified in USD
12. It is the sole responsibility of Client to bear any currency conversion costs, bank transfer fees, payment provider service fees and any other costs involved in transferring funds to me.
13. Payment is considered as received and completed only when total amount received on my account is equal to the payment amount in USDRESALE
Any designs by me are allowed to be resold for the amount you purchased it for. If it has extra art from others this does not apply, just for standalone designs.If design was not purchased but rather from raffle, giveaway, etc, you may sell for whatever amount you see fit.REFUND POLICY
13. Refunds are not available if I have started and continue to send updates.
14. Client has right to request a full or partial refund if there's been no progress for two consecutive months or hasn't been started. Refund conditions for commissions which require more work must be agreed separately, before the work commences. These provisions exclude work interruptions caused by unforeseen circumstances such as illness, accident or any other credibly documented reason for interruption of work. In the event that I feel it is done as a loophole to get a refund, one will not be given.
15. Client obliges to contact the Seller in a fast and responsive manner, responding swiftly to any requests for comments, clarifications, opinions, validation of progress etc. Lack of timely communication on behalf of Client will be recognized and no further progress will be made on the product until feedback is given. In the event that I feel it is done as a loophole to get a refund, one will not be given.
16. Refunds will not be given in the case that Client is not happy with final product. You see my art and therefore are committing to my artstyle.
17. Refunds will not be given if Client is rude, disrespectful, or anything of the sort during the process regarding critique, changes, time taken, etc. The commission will be finished and sent.
18. In the event that the Client gives go aheads but then goes back on their word after work is continued and holds this against me to try to get a refund, one will not be on the table. Product will be edited, and if Customer continues to press for one, I will complete the commission from what I have available as reference.PERSONAL AND COMMERCIAL USE
19. The Product received by Customer is for personal use. Any use of the Product for commercial purposes, reselling it, reproduction or publishing for reasons other than personal purposes has to be approved beforehand by the Seller. This will require a separate agreement between Customer and Seller defining exact conditions and financial implications of such use of the Product.Customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.In addition, Customer does not hold the right to use the product for AI datasets or for AI tools and any present or future inventions in the space.CANCELLATIONS
20. I reserve every right to refuse or cancel any order, under condition of full refund, without giving reasons to Client.
21. Any disrespectful behaviour will not be tolerated and may result in a cancellation of the order. I will have full right to refuse any service to the Client in the future.
